● APPLICATION:
Zlay: Talk & Play mobile application, which allows users to play social
games, meet new people, and communicate through chat, voice, and video calls.
● USERS: Every person who uses the Application.
● COMPANY:
Cerasus Teknoloji ve Reklam Hizmetleri A.Ş. (The owner of the Application.)
● SERVICES: Zlay: Talk & Play mobile app, website, and
related products or services.
● AGREEMENTS:
Terms of Use and Privacy Policy.
●
LINKED SITES: Any third-party
websites, applications, or commercials.
Welcome to Zlay: Talk & Play, operated by Cerasus Teknoloji ve Reklam Hizmetleri A.Ş. (“us,” “we,” the “Company,” or “Zlay: Talk & Play”).
By downloading or using Zlay: Talk & Play, Users agree and affirm that they have read and accept these Terms of Use and Privacy Policy. The Application is owned or controlled by the Company. Users who do not accept these terms do not have the right to use the Application.
We may make changes to these Agreements and to the Service from time to time. The most recent version will always apply, and material changes will be communicated to you via the Service or email. Continued use after changes take effect means you agree to the revised Agreement.
● No one
under 13 is allowed to create an account or use the Services.
● By using
the Services, you represent that:
○ You can
form a binding contract with the Company.
○ You are
not barred from using the Services under applicable law.
○ You will
comply with all applicable laws and these Terms.
○ You have
never been convicted of or pled no contest to a felony, sex crime, or violent
crime, and are not required to register as a sex offender.
○ If using the Services on behalf of a business or entity, you are authorized to accept these Terms on their behalf.
We grant you a personal, worldwide, royalty-free, non-assignable, revocable, and non-sublicensable license to access and use the Services, solely as permitted by these Terms and our Community Guidelines.
You may not:
● Use the
Services for commercial purposes without consent.
● Copy,
modify, or create derivative works from our intellectual property.
● Use bots,
scrapers, or other tools to access or extract data.
● Upload
malware, disrupt the Services, or attempt unauthorized access.
● Frame or
mirror the Service without authorization.
● Reverse
engineer or attempt to extract source code.
●
Develop third-party apps interacting with the Service without
permission.
Violation may result in suspension or termination of your account.
When you create, upload, post, or share content (messages, calls, gameplay, images, voice, etc.) on Zlay: Talk & Play, you grant us a worldwide, royalty-free, sublicensable, and transferable license to use, display, host, store, reproduce, and distribute it for operating and improving the Services.
Because Zlay: Talk & Play is a social platform, you also grant us and our partners the right to use your nickname, likeness, and voice as part of your shared content, without compensation.
We may access, review, or remove content if it violates these Terms, Community Guidelines, or applicable laws.
Services may include advertising near or around your content. By using the app, you agree to such placement.
Content posted by other users or third parties is their sole responsibility. We may review or remove content, but we are not responsible for what others post.
Report violations within the app or via support@cerasus.app.
Your privacy is important. By using the Services, you agree to our Privacy Policy, which explains how we collect, use, and share information.
You may not post or share content that:
● Infringes
intellectual property or privacy rights.
● Is defamatory,
harassing, or threatening.
● Contains
hate speech, sexual or violent content, or promotes discrimination.
● Solicits
money, scams, or impersonates others.
●
Uses another user’s
account without permission.
You must also respect Company rights: no unauthorized use of our trademarks, branding, or copyrighted materials.
We comply with copyright law and will remove infringing material if notified. If you believe your rights are violated, email support@cerasus.app with a proper copyright notice including:
● Your
signature
● Identification
of the copyrighted work and infringing material
● Contact
details
● A
good-faith statement of unauthorized use
●
A statement under penalty of perjury that you’re
authorized to act
Repeat infringers may have their accounts terminated.
We strive to keep the Service safe but cannot guarantee it. By using the app, you agree not to:
● Use the
Service illegally or dangerously (e.g., while driving).
● Circumvent
security or access restricted features.
● Post
harmful content (pornography, hate speech, threats, or violence).
●
Upload viruses or attempt hacks.
You are responsible for mobile data charges. Check with your provider before using the Services.
Some features may rely on third parties (e.g., hosting, analytics, payments via App Store or Google Play Store). Their terms govern your use of those features.
You agree to indemnify and hold harmless the Company and its affiliates from claims, damages, and liabilities arising from your use of the Services, your content, or violation of these Terms.
The Services are provided “as is.” We do not guarantee uninterrupted or error-free operation, nor that content will always be accurate or appropriate. You may encounter offensive or illegal content, and we assume no responsibility for it.
To the maximum extent allowed by law, the Company and its affiliates will not be liable for indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill.
Total liability will not exceed the greater of $100 USD or the amount you paid the Company in the past 12 months.
All claims or disputes shall be litigated exclusively in the courts of Istanbul, Turkey.
If part of these Terms is invalid, the rest remains in effect.
Some features may have additional terms presented at the time of use. By using those features, you accept them.
● These
Terms make up the entire agreement between you and the Company.
● They do
not create third-party rights.
● Failure to
enforce a provision is not a waiver.
● Rights not
granted are reserved.
● You may
not transfer rights or obligations under these Terms without consent.
●
English is the governing language.
